Medical malpractice may exist if:
- treatment does not meet the medical standard and
- it has not been carried out adequately, carefully, correctly and in a timely manner
- There are organizational deficiencies in the hospital or in a doctor’s office
- Errors in the operation and control of medical equipment were
- the attending physician has made wrong diagnostic or therapeutic decisions
- there has been insufficient information about the treatment in question.
The BKK W&F provides advice and support in the event of a suspected medical malpractice. If necessary, expert opinions can be prepared via the Medical Service, the costs of which we will cover. We will also reimburse the costs of a privately commissioned expert opinion up to the amount of 150 euros, if this is applied for in advance at the BKK W&F and the insured person gives his/her consent to the transfer to the Medical Service.
In order to check whether there has been a medical error, we need a chronological description of the course of treatment that is as chronological as possible. The following points should emerge from this:
- What was treated? Which complaints occurred when?
- Which doctors have treated? Over what period of time?
- Which findings (laboratory values, sonography, X-rays, MRI images, etc.) were collected/prepared by whom?
- Which specific accusation is made to which doctor/hospital?
- Which lawyer, if any, have you hired to represent your interests?
Since doctors and hospitals are bound by medical confidentiality, we often needed a declaration of release from confidentiality. Only with this declaration are doctors and hospitals allowed to release documents to us.
A further prerequisite is that the medical malpractice occurred when using a service of the BKK W&F.
